求助:很冤枉被银行认为诈骗~英国[讨论]

跪求各位大虾出手相救阿~
本人是一名本本分分的学生,五月时学校邮箱有一封说一个国外的公司提供part-time工作的E-mail,我就和他们联系了,讲说是像那种home-based data entry 的工作每份工作付给我120磅,我就按照他们的要求在Halifax开了个账户,并应他们要求把我得CV和一些个人信息给了他们。 之后他们出了一封雇佣信给我称这份工作是representation 也没有给具体这份工作内容的信息,其间有一个这个公司的人叫MARK给我打过很多次电话,也没有正面回复我对这份工作的具体内容的询问。之后他们告诉我会给我的银行户头里存一笔钱,让我去指定的supplier那买一些security stationery,我就相信了,因为他们讲说要把作出来的东西寄给他们的。
第二天一大早我就接到一通电话MARK告诉我有1700磅存入了我的户头,让我去取,然后自己留下120磅,把剩下的1580 pounds cash通过western union寄给在Nigeria的一个人。当时我是觉得奇怪,因为还什么都没做呢难道只用去寄一下钱就行了,可是如果不照做的话,钱都进我的户了,会不会有麻烦呢。没办法我就是着找他的要求去了bureau d exchange, 问过之后有点奇怪,他们说他们主要是做兑换外币的,我想想还是到银行去好了,MARK本来先反对让我到POST OFFICE再试试买Euro,我想还是去银行保险我就去了,他看没办法就让我在柜台取1200再到CASH MACHINE取300。到HALIFAX等了很久,给他们看了我的ID,这是他们问我说钱是从哪里来的,这个问题之前我也问过MARK,他说方便起见就说朋友汇的好了要不从头解释也太麻烦,可悲的是我竟然觉得有道理就照做了,告诉银行的人前是从国外一个朋友那里来的。之后他们就说让我联系朋友提供一下汇款凭证,他们一拿到就可以把钱给我。这时候我想起听人讲有些时候账户里能看到钱可是实际上没有到帐,我就想等两天看,在我解释过为什么没有取以及让MARK提供证明后就再没有他们的消息了。
几天后,我去查BALANCE银行把我的卡收了,询问后说是这笔1700磅的问题,银行的staff说是他们stolen from other customer's account。按照他么的要求,我把往来的邮件还有所有可能帮助他们的信息都给了他们,他们讲说这件事情一解决会在5-7天把新的卡寄给我让我不要去动这笔钱,我也把我的电话给了他们让他们有问题和我联系。两个星期内,没有任何消息。只好到HALIFAX,结果他们告诉我因为银行人员的疏忽,他们丢失了这些文件,让我再提供一遍~很郁闷的回家了,结果第二天,我无意中查我的CREDIT RECORD竟然看到HALIFAX在前一天我到银行那天并在不了解事实并没有询问我的的情况下,把我放入了CIFAS list并把我归为FIRST PARTY FRAUDS - Opening an account or other facility for a fraudulent purpose, or the fraudulent misuse of an account or facility.. 因为我还没来得及把东西重新交给他们。这时已经周末了,没办法我就写了一封信,连这几封之前受骗的E-mail 准备星期一和他们理论。一个晚上悲愤的无法入睡……
星期一,见到之前一直负责我的这件事的staff,帮我打电话到head-office,说没有办法了,已经放上去就拿不下来了。在他打电话的过程中,我有听到他们几次说我是中国人,并且好像是head-office怀疑我是潜逃了,所以这个staff向他解释我一直都有来并且提供了资料,只是他们丢了。之后没办法,我又打电话给halifax fraud department, 他们先说我不该把我得账户给他们,我说我之前也工作过很多的公司在application form上都有银行detail这一项,而我真的是认为这是一份工作而已为什么不该给;他们又说我在银行欺骗他们说是家人汇的,我说我从来没有说是家人我说的是朋友,他说那也是欺骗阿,我告诉他原因,他说为什么你回去相信一个让你撒谎的人呢,我说你也知道我是一个外国人我当然不想只是为了取那么一点钱花上半个小时来从头到尾解释;他又说你开这个账户是不是为了这笔钱,我回答当然不是我开始因为我父母要在七月中给我寄学费和生活费;然后他没办法,就又跳回第一个问题说我不该把账户告诉他们……三个问题循环的问~最终,他们讲说这是head office 的decision, 并且告诉我head office 将不会把我的cifas warning取消。我问他是不是我如果真的被骗了钱,并把这笔钱还给了halifax是不是我就不是first party fraud?他支支吾吾说也不能这么说。我又问,现在的情况任何人有损失么,前还在那里我没动,你们完全可以还给丢失的人,你们也没有任何的损失啊!他说可是账户是你开得,你把你得账户告诉了别人,我问了最后一个问题,为什么您们不去找那些骗人的人只抓住我不放?他说他们在国外我们什么也做不了只能找你了……我真是无语了。没办法,我见了他们的银行经理,本来银行经理很同情我,当然没有实质用处的同情,因为他说他们的权力很有限,帮不到我,但是当我问是否因为他们的疏忽而丢我造成这样严重的后果要负一定的责任时,他们所有的人脸都变了,就开始说当然他们是有错的,但是最终造成结果的错误始终是我,如果他们没有丢这些材料的话也只是早了一些核实我的身份而已。我就问,那是不是意味着资料没丢我就会早两个星期被定罪?经理还在说也不能这样说的时候,他身后的staff已经开始点头了。这时,再和他们还有什么好说的呢,我问她我现在的credit 状况,经理说我可以在18个月以后申请一张basic account不能刷卡买东西的那种,或者我去试试别的地方或许会运气好有银行没有查我的credit history可能能给我一张卡用,当然关于借贷信用卡之类就别想了。我已经来英国5年了,之前我的switch account 透支信用额度就已经超过500了,而这一下,我还和破产的人有什么两样?我问,这一切都是因为我在你们这里开了个账户,有不知道是什么人往我得账户里存了一笔并不大的钱,即使我没有得到任何的好处是这样么?经理说,其实就是几年的事情,过了5-6年,这个纪录就过了期限了。它还在那儿么?还在……他又说,你可以联系credit expert把你的东西发给他们让他们决定要不要保留这个warning,我说我看过网站说要找把我列在cifas list上的公司让他们也就是halifax来做这件事,他说你也可以找其他的银行让他们把这个撤下来啊,我说halifax自己都不愿负责更何况其他银行并不了解我的情况,他们怎么可能会做这件事情?经理说不管怎样如果你需要我们帮忙的话我们会写信把information提供给需要的地方,我问你愿意在信中承认我是无辜的么?他说:那我可做不到,只是information 而已……
据学校advise centre的staff讲说他们是通过先付cheque进我得账户之后再clear这笔钱,然后在我得账户里就会有一笔overdraft需要我来付清,这种方式来进行诈骗。无论是那种方式,如果我提出这笔钱给他们的话,我需要用我自己的钱来还这笔款项。不论从哪个角度来讲我都没有任何的利益,却要为此付出如此大的代价……
我把学校帮我写的信,和我自己写的信付在下面,希望有谁懂这些法律的能看在同胞的面上帮我一把,也希望给大家提个醒,英国人真的就是这样,没有人愿意承担一点点地风险来为一个外国人说句公道话,希望大家以此为戒……

Miss XX has been the victim of an internet scam where people are targeted with the offer of part time work. It transpires that the work is to act as an agent. As you are probably aware, the scam part works as the victim is asked to withdraw cash after a cheque has cleared and send the money by Western Union. As a cheque can be cancelled after it appears to have cleared, the victim can be left with a large debt. www.6park.com

Fortunately for Miss XX, Halifax spotted the company operation before any funds were withdrawn. However Halifax have frozen her account and placed her on the CIFAS database. www.6park.com

MissXX brought in details of her emails etc to the X Branch, but it appears that these have been lost by the branch. We appreciate that Halifax has to act firmly against any fraud, but Miss X appears to have been a victim in this case and is being punished for her naivety. We would ask if you could look again at Miss X's case as she has been the victim of a scam rather than the perpetrator. www.6park.com

My account number wasXXX
Because of an employment offer E-mail which sent to my university E-mail address, I was drifted into a deception. As the E-mail said, a company based Cyprus which named Dinos Antoniou & Co looking for someone to serve between them and their clients in United Kingdom and the Job will be ‘Handling all applications with regards to new clients that will like to register a company in UK and what you will be doing is Filing all papers from these individual companies which will be sent over to you under that companies name’. Firstly, this job opportunity looks totally fine as just a kind of data entry work. Secondly, this E-mail was sent to all of university students. Therefore, in fact, there was nobody suspect this job has linked to any fraud, and there was not only me trust it.
I think you know quite well about what happened next, I was provided all of my details to them even copy of my ID as they required. A couple of days before the money transferred to my account, a man who called Mark made some phone calls to me to confirm my mobile number is available and I asked many times about the details of this job and how it works, but he always said it is simple and I don’t need to worry about it. One day before the transfer, Mark called me said will send a amount of money to my account as to start the job and the money is for buying some security files which will be used when job start, and he said I need to send the money to stated stationery supplier and he doesn’t know how much it is. I thought it may worth hundreds pounds, but who knows? On the day of money arrived, Mark called me more than 20 times; he asked me to go to bureau d exchange to buy 1700 pounds sterling or euros then go western union to transfer 1580 pounds to someone in Nigeria, and it was the first time I know this amount is 1700 pounds. I surprised why I must go to bureau d exchange to get the money not bank, but he didn’t reply me and said just do as he said. After carefully asked a staff of bureau d exchange how they work about foreign exchange, I decided to go to bank because I felt something abnormal. So I told Mark bureau d exchange doesn’t let me to that, and Mark let me to go to another bureau d exchange to try and I answered that was the only one I know. About 5 minutes later, Mark called back and asked me to buy euros in post office immediately, I told Mark the post office charge a lot exchange fees if I do so, but he said he doesn’t care. I started to fell strange about everything, so I went to bank and wanted to try last time and I thought if the bank doesn’t let me to take the money out I will leave it because I don’t want to do anything riskily, and refused to answer his calls. During the waiting in the bank, Mark sent two messages to me to ask me take 1200 pounds out through Halifax bank and withdraw 300 pounds out by ATM machine. I must say thanks to the Halifax staff that rejected to take the money out even I followed Mark’s word said the money was sent by one of an overseas friend. After I answered the last call from Mark and told them my account be blocked, there was no any more replies from them.
After that, Halifax blocked my account and retained my bank card; then, I went to bank to explain everything to your staff, and your staff told me that there are a number of students were deceived because your bank found there was a fraud group transfer your customer money to one of victims’ accounts, then the account holder transfer the money to them but the victims must pay the money back when Halifax found this money was stolen from one of your customers’ account. Based on the willing of help you, I print out all of communication E-mails out on the same day as you’re required and listed two telephone numbers on the end of E-mail as I think it may can help you to trace this fraud group, and I also provided my ID and student card to one of your staff. On 26/06/08, I went to bank to check if everything be solved because I need my bank card. But surprisingly, your staff lost all of documents which I provided to your bank two weeks ago!
Today when I checking my credit record, I was astonished at what I found— I became one of criminals in this fraud in your opinion and my name was listed in CIFAS! I must say I was shock and deeply disappointed. I want you to answer some questions for me,
1. Why it is only happen in your bank but not any others, no matter your system loopholes or any other reasons, and do I with responsibility for that as just one of your normal account holder?
2. Did you give any notice to your customer to avoid more customers become victims when the first case disclosure?
3. If the fraud successes, will I get any benefit from it? With receive 120 pounds but payback 1700 pounds?
4. Did I try to use the money when I know that were stolen from other customers?
5. Do I liable for your staff lost all of evidence which I provided?
6. Even though you blocked my account and retained my card without any notice, was I showing any non-cooperation activities when you need my help?
If you also think the answers are ‘NO’, I want to ask you the final question: Why do you thing I am not a victim but belong to CIFAS Category 6– a first party of this fraud, frauds by me – the accountholder and deserve to receive this CIFAS warning? I think everyone knows what it will result in my future application related to credit.
At the end of this letter I provided two of E-mail which from my university E-mail box. Unfortunately, I couldn’t provide any more because I didn’t keep the copy of all E-mails that your staff lost.
I wish you will provide a proper settlement on my case, if not, I will not abnegate to using my prosecute rights of appeal.
